The European Union Court today upheld a decision that maintains the application of natural gas trade rules against Nord Stream 2 AG, the owner of the pipeline connecting Russia and Germany, which had appealed the ruling.
Nord Stream 2 AG had previously lost in the General Court while challenging the extension of European Union internal market rules to pipelines originating from third countries.
The European Union Court (CJEU) rejected the appeal today, thereby confirming the previous ruling of the General Court.
According to the statement, the contested rules relate specifically to the separation of gas supplies and the operation of gas transmission networks, third-party access to pipelines, and transparency.
The changes also allow Member States to provide certain exceptions for pipelines completed before May 23, 2019, given that the CJEU is not applicable in this case.
