Supreme Court's decision on the 'creamy layer' issue will not affect the seniority of CSE-2025 candidates

Official sources reported on Sunday that the Supreme Court's deliberation regarding the 'creamy layer' category for OBC representatives will not influence the seniority of successfully selected candidates from 2025, even though the allocation of their positions and the start of the preparatory course are yet to be approved.

Representatives of the Department of Public Affairs (DoPT) stated that all educational institutions and the department itself are ready to promptly appoint positions to CSE-2025 candidates and commence the preparatory course in the very near future. They emphasized that any delay in starting this course will not affect the seniority, grading, or other service conditions of these candidates.

This clarification is related to the Supreme Court's ruling of March 11 in the case of Rohit Nathan. In this decision, the court ruled that 'salary' cannot be included in the concept of 'income' when determining the criteria for the 'creamy layer' for any category of OBC candidates, including those whose parents work in public sector undertakings (PSU) or banks.

The judicial decision concerned a situation where candidates from public sector enterprises were previously classified as 'creamy layer' due to the inclusion of their parents' 'salary' in the calculation of 'income.'
