Teachers are responsible for educating and ensuring the safety of children in schools. However, situations periodically arise where educators use physical violence or behave inappropriately towards students. In state educational institutions, if a complaint is received about such a teacher, actions may be taken, ranging from an internal investigation to dismissal.
The question arises whether the same rules apply to private schools. Are the same norms regarding physical punishment of children applied to private school teachers?
It is confirmed that private schools are not exempt from these rules. The provisions of the RTE Act apply to both state and private schools regarding accreditation. Schools affiliated with CBSE are obliged to follow the CBSE Affiliation Charter and relevant safety regulations. CBSE has also issued clear instructions regarding the protection of children from violence and ensuring their safety in schools.
According to the council's rules, the school management committee is obliged to guarantee the safety of children. The school administration is also responsible for taking action regarding disciplinary issues related to teachers and staff, in accordance with current regulations.
The main difference lies in the procedure for taking action. In the case of a state teacher, the investigation may be conducted within the framework of state service rules. Whereas in a private school, action against a teacher may be taken according to the school's internal rules, the legislation of the relevant state, and if the school is affiliated with CBSE, then according to CBSE rules.
Thus, it cannot be claimed that action against a teacher who beat a child can only be taken in state schools. Rules protecting children from physical punishment or violence also apply in private educational institutions. Nevertheless, the process of suspending or firing a teacher from a private school may differ from the process in a state school. This depends on which council the school is affiliated with, what rules are in force in the respective state, and under what conditions the teacher was hired.
